1. Acceptance of Terms

By accessing this website, submitting information, purchasing advertising, or entering into any agreement with Australian Business Pages Pty Ltd (“Company”, “we”, “our”, or “us”), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

We may amend these Terms from time to time by publishing updated Terms on our website. Continued use of the website or services following any amendment constitutes acceptance of the revised Terms.

Nothing in these Terms excludes, restricts, or modifies any right or remedies that cannot lawfully be excluded under the Australian Consumer Law or any applicable law.

 

2. Publications of Listings

All listings will be published within 24 hours of contract execution. 

Any amendments to listing content, artwork, or business details must be submitted strictly in writing.

 

3. Contract Term and Automatic Renewal

Unless otherwise agreed in writing, all advertising and listing agreements are for a minimum fixed term of twelve (12) months.

Unless written notice of cancellation is provided at least 30 years prior to the expiry of the current term, the agreement may automatically renew for successive renewal periods.

We will provide reasonable notice of any renewal where required under applicable law.

Fees paid are generally non-refundable except where required under the Australian Consumer Law or otherwise expressly stated in writing.

 

4. Cancellation Policy

Cancellation requests must be submitted in writing.

Where cancellation is requested within 24 hours of entering into the agreement and services have not substantially commenced, we may, at our discretion, permit cancellation.

Following commencement of services, agreements may not be cancelled for change of mind or business performance reasons unless otherwise required under applicable law.

Nothing in this clause limits any right or remedies available under the Australian Consumer Law.

 

5. Authority to Contract

By signing or agreeing to any services, you warrant that you are a duly authorised representative (including director, owner, or delegated authority) of the business.

The Company will not accept:

  • Claims of lack of authority
  • Internal disputes
  • Unauthorised signatory arguments

as valid grounds for cancellation or dispute. Full liability remains with the contracting party.

 

6. Payment Terms and Recovery

Invoices are payable within seven (7) days unless otherwise stated.

Where payment remains outstanding beyond 30 days, we reserve the right no:

  • suspend listings or services;
  • charge reasonable administrative and recovery costs incurred in recovering overdue amounts;
  • apply interest on overdue amounts at a reasonable rate permitted by law;
  • engage debt collection agencies or commence legal proceedings where necessary.

You agree to reimburse reasonable costs incurred by Australian Business Pages Pty Ltd in recovering overdue amounts, including debt recovery and legal costs on a solicitor-client basis where permitted by law.

 

7. Submission and Licence of Content

You retain ownership of any intellectual property rights in content submitted to Australian Business Pages Pty Ltd.

By submitting content, you grant us a perpetual, worldwide, non-exclusive, royalty-free licence to use, reproduce, modify, publish, distribute, display, and promote such content in connection with our website, directory services, advertising, and business operations.

You warrant that:

  • you own or have authority to use the content;
  • the content does not infringe third-party rights;
  • the information provided is accurate and not misleading.

You accept responsibility for any claims arising from the content you submit.

 

8. Listing Eligibility and Acceptable Use

Listings must relate to legitimate businesses operating within Australia and include accurate Australian contact details.

Users must not:

  • submit false or misleading information;
  • impersonate another business or person;
  • upload unlawful, defamatory, abusive, or infringing material;
  • manipulate reviews or ratings;
  • introduce malicious software or interfere with website operations.

We reserve the right, acting reasonably, to reject, remove, suspend, or modify listings or content that breach these Terms or may expose us to legal or reputational risk.

 

9. Website Availability and Technical Limitations

All services are provided strictly on an “as is” and “as available” basis.

The Company makes no guarantees regarding:

  • Continuous availability
  • Functionality or performance
  • Error-free operation
  • Security or absence of viruses

Temporary interruptions, data loss, or display issues may occur without liability.

 

10. Third-Party Content and Links

The website may include links or references to third-party websites, services, or advertisers.

The Company:

  • Exercises no control over third-party content
  • Accepts no responsibility for external sites
  • Provides no endorsement or warranty of third-party services

Accessing third-party content is entirely at your own risk.

 

11. Intellectual Property

All website content is protected under applicable copyright and intellectual property laws.

No material may be copied, reproduced, distributed, or commercially exploited without prior written consent from Australian Business Pages Pty Ltd.

Unauthorised use may result in legal action.

13. Data Retention and Caching

Listings and associated data may remain visible online following termination due to caching or system processes.

Removal requests must be submitted in writing and will be processed at Australian Business Pages Pty Ltd discretion.

 

14. Limitation of Liability

To the maximum extent permitted by law, Australian Business Pages Pty Ltd excludes all liability for indirect, incidental, special, or consequential loss, including:

  • loss of profits;
  • loss of business opportunity;
  • reputational damage;
  • loss of data.

We do not guarantee:

  • uninterrupted website availability;
  • search engine rankings;
  • customer enquiries or business outcomes;
  • error-free operation.

Where liability cannot legally be excluded, or liability is limited, at our option, to:

  • resupplying the relevant services; or
  • paying the cost of resupplying those services.

Nothing in these Terms excludes rights under the Australian Consumer Law.

 

15. Indemnity

You agree to fully indemnify and hold harmless Australian Business Pages Pty Ltd, its directors, employees, and affiliates against any and all claims, liabilities, damages, losses, or expenses arising from:

  • Your use of the services
  • Your breach of these Terms
  • Any content you submit

This indemnity survives termination of the agreement.

 

16. Enquiries

All enquiries, disputes, or notices must be submitted in writing to Australian Business Pages Pty Ltd. Australian Business Pages Pty Ltd is under no obligation to respond to informal or verbal requests.

 

17. Governing Law

These Terms are governed by the laws of Queensland, Australia.

Any dispute arising in connection with these Terms or the services shall be subject to the exclusive jurisdiction of the courts of Queensland.

 

18. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy available under the Australian Consumer Law or any other law that cannot be legally excluded.

To the extent permitted by law, our liability for breach of any non-excludable guarantee is limited to:

  • resupplying the services; or
